What Is a Felony In Massachusetts?
Massachusetts law classifies crimes according to their punishment as either felony or misdemeanor. A felony is defined as a crime punishable by death or imprisonment in a state prison. All other crimes are misdemeanors. (M.G.L. Ch 274 s.1).
District Court:
has jurisdiction over all misdemeanors and some felonies punishable by imprisonment in the state prison for up to five years. (M.G.L. Ch 218).
Superior Court: has jurisdiction over all misdemeanors and felonies.
Therefore, when searching for felonies in Massachusetts, it is important to search both the upper and the lower court.
